BREAKING: Tennessee rancher notifies AG Merrick Garland of Motion to Compel Rule 35 Neuropsychological Examination of President Biden in case seeking writ of mandamus for Biden’s failure to make appointments to vacant positions on the Farm Credit Administration Board.
The lawsuit filed by Dustin Kittle in the Middle District of Tennessee seeks a federal court order directing President Biden to make the Board appointments, which the rancher’s attorney says is a “non-discretionary act required of him as President under the law”. The rancher’s attorney argues a neuropsychological exam is necessary to determine if Biden has the requisite cognitive function to discharge “his official powers and duties”, saying if he doesn’t, “not only is the requested relief an inadequate remedy for Plaintiff to be seeking, but the Defendant may ultimately be the improper party from whom to seek such relief.”
The rancher’s attorney says the Motion will be filed following the federal court’s Case Management Conference set to take place on July 30th before Judge Campbell. The U.S. Attorney’s Office representing Biden has said it intends to oppose the Motion.
The rancher’s attorney cites the House Committee on Oversight’s investigation into Biden’s personal physician, Dr. O’Connor, and the Committee’s concerns over the President’s “ability to do his job” and that he has “lost all independence.” The motion for a neuropsychological examination quotes the Committee saying it “seeks to understand if [Dr. O’Connor is] in a position to provide accurate and independent review of the President’s fitness to serve.”
It also cites various reports from federal officials and medical experts over the President’s cognitive decline, including Special Counsel Robert Hur, as well as quotes from Biden himself that raise concerns over his cognitive decline.
The rancher filed a federal lawsuit against Biden in March for the President’s failure to make appointments to the Board of the U.S. Farm Credit Administration. The rancher submitted a complaint to the Farm Credit Administration, the executive branch agency tasked with regulating farm credit lenders, that his lender was illegally extorting him. At the time his complaint was pending with the agency, the Board had, at times, no members serving in current terms due to Biden’s inaction.
This meant that, despite agency policy saying complaints should receive a final response within 30-60 days, the Farm Credit Administration took a record-breaking 657 days to give the rancher a final response on his borrower complaint before ultimately confirming his lender violated numerous federal laws and regulations. The response came too late, however, as the rancher was forced to sell land, livestock, equipment, etc. to avoid the illegal threats from his lender.
In their final response, the agency said because the rancher was no longer a farm credit borrower after their nearly 2 year delay in responding to his borrower complaint, it wouldn’t be doing anything to fix the lender’s illegal threats and extortion that caused him to lose his farmland, livestock, equipment, and to lay off nearly a dozen workers.
The Farm Credit Administration is rare in that it is an executive branch agency NOT funded through appropriations – it’s funded by the farm credit borrowers themselves, who pay Board Members’ salaries and the agency’s operating expenses in exchange for the agency enforcing the protections provided to them under the Farm Credit Act, Farm Credit regulations, and the Equal Credit Opportunity Act. Because current legal precedent precludes farm credit borrowers from suing their lenders in court for violations of their rights, enforcement by the Farm Credit Administration is their only source of protection from their lenders.
Presently, the agency only has one Board Member in a current, legal term. Biden appointed the first openly gay Board Member, Vincent Logan, to lead the agency in 2022; but despite the two other Board positions being vacant, Biden made no other appointments to fill those vacancies in his nearly full term in Office until the lawsuit was filed, with one nominee pending Senate confirmation and one vacancy remaining.
Biden’s failure to make the appointments has accomplished the following during the FCA’s 108 year history:
Longest period with a two-Member Board (40 months);
Longest-serving Board Member in history (Obama appointee Jeff Hall serving 9 years (term expired in 2018; successor’s term expires October 13, 2024)
In 86 days, the first Board Member to ever succeed himself in violation of federal law
Longest investigation into a farmer-borrower complaint at 657 days

I very much admire Dustin for his courage in going up against the US Government, which can be brutal toward the people over whom they have so much power (though, since the Supreme Court overturned the Chevron doctrine of deference to government agencies, that might be changing).
